On July 17, 2014, Novartis Pharma AG (“Novartis”) disclosed in its financial report for the quarter ended June 30, 2014 that Novartis is a respondent and counter-claimant in an arbitration proceeding commenced by Vanda Pharmaceuticals Inc. (“Vanda”) in May 2014 relating to the license of Fanapt®. Vanda has requested an award of approximately $539 million in such proceedings. Vanda is vigorously prosecuting its claims in the arbitration as well as defending counterclaims brought by Novartis. Vanda currently anticipates that the arbitration proceeding will be completed within 12 to 18 months.
