On June 16, 2014, Vanda Pharmaceuticals Inc. (the “Company”) filed suit against Roxane Laboratories, Inc. (“Roxane”) in the United States District Court for the District of Delaware. The suit seeks an adjudication that Roxane has infringed one or more claims of the Company’s U.S. Patent No. 8,586,610 (the “Patent”) by submitting to the U.S. Food and Drug Administration an Abbreviated New Drug Application for generic versions of iloperidone oral tablets in 1 mg, 2 mg, 4 mg, 6 mg, 8 mg, 10 mg, and 12 mg strengths. The relief requested by the Company includes a request for a permanent injunction preventing Roxane from infringing the asserted claims of the Patent by engaging in the manufacture, use, offer to sell, sale, importation or distribution of generic versions of iloperidone before the expiration of the Patent in 2027.
