On September 5, 2012, the Corporation received an order issued by the Mine Safety and Health Administration (“MSHA”) under section 107(a) of the Federal Mine Safety and Health Act of 1977 at its Garner Quarry in Garner, North Carolina. The order stated that a front-end loader was observed along the high wall of the number three level Barr pit without a berm in place. The loader’s bucket was observed clearing the edge of the wall and a tire was approximately eight feet from the edge of the wall. The Corporation constructed a berm at the opening and the order was terminated.
