Item 8.01. Other Events
 
 
On July 20, 2012, the United States International Trade Commission (ITC) issued a decision in the case of Matter of Certain Mobile Telephones and Wireless Communication Devices Featuring Digital Cameras and Components Thereof, filed by Eastman Kodak Company (Kodak) against Apple Inc. (Apple) and Research in Motion Inc. (RIM).  In its decision, the ITC concluded that Apple’s iPhone 3G and the accused RIM BlackBerry devices infringe Kodak’s United States Patent No. 6,292,218 (‘218 patent).  The ITC affirmed, on modified grounds, the previous recommendation of an ITC administrative law judge, concerning the invalidity of the asserted claim of the ‘218 patent on grounds of obviousness based on certain prior art.  Kodak intends to appeal the decision relating to invalidity of the ‘218 patent to the United States Court of Appeals for the Federal Circuit.
