Item 1.03 Bankruptcy or Receivership
 
On July 9, 2012, Patriot Coal Corporation (“Patriot”) and its wholly owned subsidiaries listed on Exhibit 99.1, which is incorporated by reference herein, (the “Filing Subsidiaries” and, together with Patriot, the “Debtors”) filed voluntary petitions for reorganization under chapter 11 of title 11 of the U.S. Code (the “Bankruptcy Code”) in the Bankruptcy Court for the Southern District of New York (the “Court”).  Patriot’s chapter 11 case is being administered under the caption In re: Patriot Coal Corporation (Case No. 12-12900).  The Debtors have filed a motion with the Court seeking to jointly administer all of the Debtors’ chapter 11 cases under the caption In re: Patriot Coal Corporation, et al.  The Debtors will continue to operate their businesses as “debtors-in-possession” under the jurisdiction of the Court and in accordance with the applicable provisions of the Bankruptcy Code and orders of the Court.
