On July 21, 2010, the Dodd-Frank Wall Street and Consumer Protection Act (the Act) was
enacted. Section 1503 of the Act requires a Current Report on Form 8-K if a company is issued an
imminent danger order under Section 107(a) of the Federal Mine Safety and Health Act of 1977 by the
federal Mine Safety and Health Administration (MSHA).
On July 27, 2011 the Federal No. 2 mine received an imminent danger order issued by MSHA
relating to MSHAs determination that additional roof support was needed in a newly developed area
of the mine. Although no roof fall occurred and the area was supported in accordance with the
approved roof control plan, the Company installed additional roof support as a precaution. Mining
operations were not affected by the order and the 107(a) order has been terminated. Patriot
intends to contest the issuance of the order. No injuries resulted from the condition described in
the order.
