On October 4, 2010, the Debtor filed a liquidating plan with the Court.  The Debtor and Official Committee of Unsecured Creditors are negotiating the terms of an amended plan.

The Debtor has filed two adversary proceedings against the FDIC, and has objected to the priority proof of claim asserted by the FDIC.  The outcome of the Debtor/FDIC litigation will determine the amount available for distribution to creditors.
