Item 8.01. Other Events.
     On August 31, 2010, Patriot Coal Corporation (“Patriot”) issued a press release announcing that the Federal District Court in Huntington, West Virginia issued rulings in connection with pending selenium lawsuits relating to Patriot’s Apogee and Hobet mines.
     A copy of the press release is attached hereto as Exhibit 99.1 and is incorporated herein by reference.
