On February 2, 2010,
Massey Energy Company (the “Registrant”) issued a press release regarding its
unaudited financial results for the three and twelve
months ended December 31, 2009. The press release is
attached hereto as Exhibit 99.1 and is incorporated by reference into this Item
2.02.
