ITEM 7.01                         REGULATION FD DISCLOSURE

Management of The Cheesecake Factory Incorporated (the “Company”) presented at the Morgan Stanley Global Consumer & Retail Conference in New York City on November 19, 2009 (as previously disclosed on Form 8-K filed with the SEC on November 13, 2009).  To clarify comments made during the conference, the Company reiterates guidance for fiscal year 2010 of diluted earnings per share of between $1.00 and $1.10, based on an assumed range of comparable sales of between -1 and -2%.  This guidance was previously disclosed in the Company’s earnings conference call held on October 22, 2009.  Any discussion at the conference by management regarding fiscal year 2011 was for illustrative purposes only and the Company clarifies that it has not issued guidance for the 2011 fiscal year, including with respect to estimated comparable sales.
